Welcome to Miami’s Top Water Tours (“we,” “our,” “us”). By accessing or using our website and services, you agree to comply with and be bound by the following Terms and Conditions (“Terms”). Please read these Terms carefully before making a booking.

Non-Refundable Bookings: All bookings, including promotional tickets, are non-refundable once confirmed.
Rescheduling: Requests must be made at least 24 hours before departure, subject to availability. No Exceptions.
Requests made less than 24 hours prior cannot be accommodated.
Rescheduling requests due to, but not limited to, traffic, rain, flight delays, transportation issues, parking or other circumstances beyond our control cannot be accommodated.
Departure Times: Approximate and may vary due to operational or unforeseen circumstances. Arrive at least 30 minutes early.
Weather & Safety: Tours operate rain or shine. If we cancel for safety, you may reschedule or receive a refund.
Force Majeure: We are not liable for delays/cancellations caused by extraordinary events beyond our control (e.g., weather, strikes, government actions).
All 90 Minute Sightseeing Tours: All ages welcome. Alcohol purchases require valid government-issued photo ID (21+).
Yacht Party Experiences (including Miami’s Top Yacht Party: Neon Nights with Open Bar Cruise or similar, with names subject to change) and any nightclub experiences: 21+ only. Valid government-issued photo ID required.
Third-Party Tickets: Purchases made through resellers (e.g., Groupon, Viator, GetYourGuide) are subject to their terms. All changes/cancellations must be handled directly with the reseller.
1. Booking & Payment
1.1 Booking Confirmation – Upon completing a booking through our website, you will receive a confirmation email detailing your tour or activity. Please review all information for accuracy.
1.2 Payment – Full payment is required at the time of booking to secure your reservation. Bookings are confirmed once payment is successfully processed and you receive a confirmation number.
1.3 Age Restrictions by Product
All 90 Minute Sightseeing Tours: Open to all ages. Alcohol purchases on board require presentation of a valid, government-issued photo ID verifying age 21+.
Yacht Party Experience (including Miami’s Top Yacht Party: Neon Nights with Open Bar Cruise or similar, with names subject to change) and any nightclub experiences: Strictly 21+ only. Valid government-issued photo ID is required at boarding (see Section 2).
2. Identification & Boarding Requirements
2.1 Identification Requirements
All 90 Minute Sightseeing Tours: Guests of all ages are welcome. Alcohol purchases on board require presentation of a valid, physical government-issued photo ID verifying that the guest is 21 or older.
Yacht Party Experience (including Miami’s Top Yacht Party: Neon Nights with Open Bar Cruise or similar, with names subject to change) and any nightclub experiences: All guests must be 21 or older with no exceptions. A valid, physical government-issued photo ID is required at check-in. Digital copies, expired IDs, or photos are not acceptable. Refusal to provide valid ID will result in denial of boarding; no refund or credit will be issued in such cases.
2.2 Arrival Time – Guests are advised to arrive at the embarkation point at least 30 minutes before scheduled departure to allow for a smooth check-in, seat selection and boarding process.
2.3 Late Arrivals & No-Shows – Tours depart promptly at scheduled times. Late arrivals may be placed on standby for the next available tour, subject to availability. We cannot guarantee accommodation or issue refunds for late or missed arrivals.
3. Cancellations & Rescheduling
3.1 Non-Refundable Bookings – All bookings made through our website are non-refundable. Once confirmed, we cannot issue refunds for cancellations or no-shows. This includes all promotional tickets, discounted offers, and special sales.
3.2 Rescheduling Requests – Reschedule requests must be submitted at least 24 hours prior to departure by one of the following methods:

Rescheduling is subject to availability. Requests made less than 24 hours before departure cannot be accommodated and will result in forfeiture of your booking.
Important: Rescheduling requests arising from circumstances outside our control—including but not limited to traffic, rain, flight delays, or other transportation issues—do not constitute valid grounds for rescheduling. Guests are responsible for planning adequate travel time and contingencies.
3.3 Peek Protect (Optional Coverage) – During checkout, you may choose to purchase Peek Protect, a booking protection service provided by Spot.
Peek Protect allows cancellations up to 24 hours before your activity with a refund.
Refund requests must be submitted directly to Spot via:

Miami’s Top Water Tours does not directly handle refunds through Peek Protect.
4. Third-Party Reseller Purchases
Tickets purchased through a third-party reseller (e.g., Groupon, Viator, GetYourGuide, Expedia) are subject to the terms and conditions of that reseller. For any cancellations, rescheduling, or changes to third-party tickets, guests must make arrangements directly with the reseller. Please note that most resellers require a minimum of 24 hours advance notice for cancellations or rescheduling. Miami’s Top Water Tours is unable to adjust, refund, or modify third-party tickets.
5. Scheduled Departure & Operational Variability
5.1 Approximate Sailing Times – All sailing and departure times are approximate and subject to change. We operate under an operational schedule, with departures contingent upon safety checks, dock availability, loading procedures, weather, and other operational factors.
5.2 Unforeseen Circumstances – Departure times may be extended, delayed, rescheduled, or shortened due to unforeseen circumstances beyond our control, such as weather conditions, safety concerns, mechanical requirements, or other irregular operations. Sailing and arrival times may vary, similar to airline schedules.
5.3 Cancellations by Us – No compensation, refund, or rearrangement will be provided unless the trip is cancelled entirely by us.
6. Weather, Delays & Early Returns
6.1 Rain & Weather Policy – Tours operate rain or shine, with safety being our highest priority. If severe weather or unsafe conditions require us to cancel or reschedule, you will be notified promptly and offered either a full refund or the option to reschedule.
6.2 Early Returns – If we terminate a tour early due to a medical emergency, mechanical issue, or other operational necessity, we will:
Endeavor to notify guests onboard
Escort the vessel back safely, and
Provide no further refund or compensation beyond the prorated value of time aboard, at our discretion.
7. Guest Responsibilities
7.1 Accuracy of Booking Details – Ensure that all booking details provided are accurate. We are not responsible for issues arising from incorrect details.
7.2 Special Requirements – Guests must notify us of any medical conditions or special requirements at the time of booking.
8. Liability
8.1 Assumption of Risk – Participation in our tours involves inherent risks. By booking, you acknowledge and accept these risks.
8.2 Limitation of Liability – Our liability is strictly limited to the amount paid for your tour. We will not be responsible for indirect, incidental, or consequential damages resulting from schedule changes, delays, or shortened outings.
8.3 Guest Planning – Guests are advised to account for potential schedule variability in their travel plans.
9. Force Majeure
We shall not be liable or responsible for any failure or delay in performance arising out of or caused by, directly or indirectly, forces beyond our reasonable control. This includes, but is not limited to: acts of God, natural disasters, inclement weather, government actions, labor disputes, strikes, civil commotion, terrorism, pandemics, or mechanical breakdowns. In such circumstances, refunds or rescheduling will be provided at our sole discretion.
10. Changes to Terms
We reserve the right to update these Terms at any time without notice. Updates will be effective upon posting on our website. The version in place at the time of booking will apply.
